“JUKI” receives legal protection as a well-known trademark in China
On December 21, 2018, the registered trademark “JUKI” of JUKI CORPORATION received legal protection as a well-known trademark in China based on a written judgment of the Beijing Higher People’s Court.
“Well-known trademark” means a trademark widely known to Chinese consumers in the relevant industry that is recognized by the Trademark Office of CNIPA, the Trademark Review and Adjudication Board, or the People’s Court pursuant to Chinese trademark law, so receiving stronger protection than ordinary trademarks.
In the lawsuit in which JUKI CORPORATION demanded the cancellation of the application made by another company for a “JUKI” trademark, the Beijing Higher People’s Court found that the registered trademark “JUKI” of JUKI CORPORATION was a well-known trademark.
The judgment stated, “The registered trademark No. 146917 ‘JUKI’ of JUKI CORPORATION has been advertised and used for a long period of time for ‘sewing machines and parts’ and is already well known to the relevant public in China. It has a good reputation and is recognized as a well-known trademark.”
JUKI CORPORATION has been engaged in the business in China for nearly 40 years through the sale of industrial sewing machines and the provision of relevant services since the establishment of its office in Beijing, China in 1980.
